Rules and Regulations:
The Arc of Winnebago, Boone and Ogle
Counties, herein after referred to as
"The Arc", is a nonprofit Illinois
corporation, a tax-exempt organization
under federal and state laws. The Arc
helps families to raise their child
diagnosed with a developmental
disability at home and supports adults
to live in their community, close to
work, family and friends through the
provision of these programs: Family
Support, Guardianship Assistance, Home
Based Service Coordination, Family
Assistance Coordination, Independent
Living Support, Project Art, and
Beadware. The Arc is conducting this
raffle as a way to raise funds to cover
a portion of the cost of providing these
services. The official rules and
regulations of the Great Home Giveaway
raffle are set forth below. By
purchasing a raffle ticket, you agree to
be bound by these rules and regulations.
The Arc interpretation and application
of the rules and regulations shall be
final.
Tickets:
Raffle tickets are $20 each, payable to
"The Arc." Special ticket pricing of 3
for $50 is available until the end of
July 22nd. through limited
outlets. Big Spender specials of 7 for
$100, 15 for $200 and 50 for $500 are
available through limited outlets to
October 9 2008. No more than 25,000
tickets will be sold. Raffle tickets
must be purchased by 6:00 p.m. on
October 9 2008. Tickets may sell out
prior to such time. All sales
transactions are final. Only ticket
holders with validly paid tickets are
eligible to participate in the raffle.
Any purchase requests received with
payment after 25,000 tickets have been
sold or after 6:00 p.m. on October 9
2008 will be returned. No other refunds
are available. Only one eligible person
may be entered in the raffle per ticket
sold. The Arc will record the name and
contact information of that person as
the holder of record of that particular
ticket. Prizes will be awarded only to
the holder of record of a winning
ticket. If the name of more than one
person is submitted with a ticket
purchase, and that ticket is selected as
a winning ticket, then the person named
first will be deemed the holder of
record of that ticket and declared the
winner. Division of a prize by a group
purchasing a ticket in common shall be
the sole responsibility of the person
named as the holder of record of that
ticket, should that ticket be selected
as a winner. The Arc of Winnebago, Boone
and Ogle Counties assumes no
responsibility for lost, late,
misdirected or non-delivered mail or
other failure to deliver tickets prior
to any deadline. Purchases of raffle
tickets are not tax-deductible
contributions.
How to Purchase:
Tickets may be purchased from an
employee or agent of The Arc of
Winnebago, Boone and Ogle Counties, and
paid for by cash, check, or VISA/Mastercard
or Discover credit card. Purchases may
be made by phone at 815 965 3455, by fax
at 815 965 3673, by mail to The Arc of
Winnebago, Boone and Ogle Counties, 1222
East State St, Rockford, IL 61104. Order
on line or print out an entry form on
The Arc of Winnebago, Boone and Ogle
Counties’ web site, www.arcwbo.org.
Tickets are available at the house
during The Parade of One,The Parade of
Homes and during the open house hours
each weekend until the final drawing
date. Single tickets only are available
at: Associated Bank, Benson Stone Co.
WTVO, Logli Supermarkets, Cub Foods,
Shelving Unlimited, Al Grace
Appliance, Visions Lighting, Howlett
Homes, Belvidere Pacemaker, Belvidere
Bank, Snyder Drugs in Oregon, Byron and
Winnebago. You may buy as many available
tickets as you want. The Great Home
Giveaway grand prize winning ticket will
be drawn at random on or about October
9 2008 from all eligible raffle tickets
received. The Arc of Winnebago, Boone
and Ogle Counties will conduct the
drawing. Ticket holders do not need to
be present to win. Winners will be
notified by phone or U.S. mail,
according to the contact information
provided to The Arc at the time of
ticket purchase. The odds of winning a
prize will depend on number of raffle
tickets sold. If all 25,000 tickets are
sold, the odds of winning the Grand
Prize are 1 in 25,000. Your odds will
improve if fewer tickets are sold. Early
Bird drawings will occur on or about:
July 9 2008, July 30 2008, August 21
2008, September 11 2008 and September 25
2008. Winners will be drawn from all
eligible tickets purchased prior to the
drawing time. Winners of the Early Bird
raffle drawings will be entered in the
Grand Prize raffle drawing. The IRS
requires that taxes on prizes valued at
$5,000 or more must be paid before prize
distribution.
Eligibility:You
must be 18 years old or older and a
resident of the USA to purchase tickets
or win a prize. Employees and Directors
of The Arc, WTVO and Howlett Homes, and
persons living in the same household as
those board members and employees, are
not eligible to win the Early Bird
Prizes or The Grand Prize.

Restrictions:
No substitutes for prizes will be made.
Winners assume all local, state and
federal taxes, fees, closing costs,
title insurance charges, transfer taxes,
and incidental expenses where
applicable. Payment of withholding tax
is required by the IRS at the time of
transfer of the grand prize to the
winner. An agreement of transfer between
the winner and The Great Home Giveaway
contractor must be executed within forty
five (45) days after notice of the
award. No warranties or guaranties,
expressed or implied, are made or
offered by The Arc. The home will be
transferred in an "as is" condition
without furnishings. Contractor’s
warranty shall be assigned to winner.
The Arc does not guarantee that the
Grand Prize winner will be able to sell
the home for its estimated value of
$184,000. Tax authorities may place a
different value on the home for the
purpose of determining any income,
property, transfer or other taxes that
may be due from the Grand Prize winner.
If any winner cannot be located by 6:00
pm November 11, 2007, after exhausting
all reasonable attempts to do so, or if
the winner is deemed to be ineligible,
such winner will be deemed to have
forfeited his or her prize. Another
eligible winner will be selected for
such prize by random drawing. Winners
must claim their Early Bird prizes
within fourteen (14) days after notice
of the award. If a winner does not claim
the prize within such fourteen (14) day
period, such winner will be deemed to
have forfeited his or her prize and
another winner will be selected for such
prize by random drawing. A list of
winners may be obtained by requesting a
list, in writing, to The Arc together
with a self-addressed envelope, no later
than October 27 2008.
General Terms and Conditions:
By purchasing a raffle ticket you agree
to be bound by these official rules and
regulations and the decisions of The
Arc, which shall be final. Winners may
be required to execute an affidavit of
eligibility and a publicity release
permitting The Arc to use their name,
photograph, likeness and voice for
promotional purposes in any media. The
Arc is not responsible for any injuries,
losses or damages of any kind arising in
connection with or as a result of the
winner’s acceptance or use of any prize.
By entering the raffle, each participant
releases The Arc of Winnebago, Boone and
Ogle Counties, its directors, officers,
employees and agents from any and all
liability for injuries, losses or
damages of any kind caused by any prize
or resulting from acceptance,
possession, use or misuse of any prize,
and each winner agrees to indemnify and
hold The Arc harmless from any and all
losses, damages, rights, claims and
actions of any kind arising in
connection with or as a result of the
winner’s acceptance or use or any prize.
Disclaimer of all representations and
warranties: There are no
representations or warranties other than
as set forth in these official rules and
regulations. The Arc disclaims all other
representations and warranties express
or implied, regarding the raffle,
including but not limited to, any
implied warranties or merchantability or
fitness for a particular purpose. A
raffle participant’s sole and exclusive
remedy for The Arc’ breach shall be
limited to the return of the purchase
price paid for his/her raffle ticket(s).
In no event shall The Arc be liable to
any party for any loss or injuries to
earnings, profits or goodwill, or for
any incidental, special, punitive or
consequential damages of any person or
entity whether arising in contract, tort
or otherwise, even if The Arc has been
advised of the possibility of such
damages. |
